Partner (Provisional) visa (subclass 820) and Partner (Permanent) visa (subclass 801) Onshore

Summary:

Partner visa (subclass 820) and Partner visa (subclass 801) Visa which allows Partners or spouse of eligible sponsors who are currently in Australia to live in Australia. First stage is Partner visa (Subclass 820) Temporary visa, this visa is an onshore visa application, it allows you remain in Australian until a decision has been made on you stage 2 visa, Permanent Partner visa (Subclass 801).

 

Please note, the above-mentioned visa are onshore visa application, hence, must be lodged and granted whilst in Australia. Conditions apply.

 

The waiting period from Partner (Provisional) visa (Subclass 820) to Partner (Permanent) visa (Subclass 801) is a 2 year wait from the date of your Partner (Provisional) visa (Subclass 820) is granted. Once you finish the 2 year you will now be on your final visa Partner (Permanent) visa (Subclass 801).

 

Who can apply:

You can apply for this visa If you are the partners or spouse of someone who is the following; 

  • Australian Citizen
  • Permanent Australian Resident
  • Eligible New Zealand Citizen

 

This Visa allows you to do the following:

Temporary Partner visa 820;

  • Live and Remain in Australia with your Australian Sponsor while you wait for your Permanent visa Partner (Subclass 801) visa
  • Study in Australia provided you can cover the study fees
  • Enrol to obtain an Australian Medicare Card

Permanent Partner visa 801; 

  • Allows you to Study in Australia
  • Work in Australia
  • Enrol to obtain an Australian Medicare Card

 

Visa Requirements:

An applicant of (Subclass 820) visa must meet the requirements of the following;

  • Both visa Applicant and their Sponsor must be in a “genuine” relationship must provide evidence for their claim
  • That their marriage is valid and recognised in Australian Law
  • If in a De-facto relationship, must prove they have a committed relationship for 12 months prior to the date of application
  • Must meet Health Requirements
  • Must meet Character Requirements

An applicant of (Subclass 801) visa must meet the requirements of the following;

  • Must Hold Temporary Partner visa (Subclass 820) to be eligible for Subclass 801
  • Must continue to be in Genuine Relationship while you remain in Australia
  • If you Relationship has end you must provide Evidence of your circumstances to be eligible for (Subclass 801) visa
  • Must meet Health Requirement
  • Must meet Character Requirement

Visa Validity:

The Partner (Provisional) visa (subclass 820) is temporary visa. The visa is valid from the date of grant until a decision has been made on you Permanent Partner visa (Subclass 801 onshore application.

The Partner (Migrant) visa (subclass 801) is a permanent visa final stage to Permanently remain and live in Australia Indefinitely.

Partner (Provisional) visa (Subclass 309) and Partner (Migrant) visa (Subclass 100) Offshore

Summary:

Partner (Provisional) visa (subclass 309) and Partner (Migrant) visa (subclass 100) Visa allows Partners or spouse of eligible sponsors to travel and live in Australia. The first Stage to this visa is the grant of your Partner (Provisional) visa (subclass 309). This is a Temporary visa applicant must be outside at the time of visa lodgement, essentially means that the spouse must be outside of Australia to apply and must be outside at the time visa grant.

 

After granted the (Subclass 309) visa you can enter and live in Australia and wait for the remaining period till your Partner (Migrant) visa (subclass 100) is granted

Prospective Marriage Visa (Subclass 300)

Summary:

Prospective Marriage Visa (Subclass 300) is temporary visa lodge offshore, eligible applicants are able to Marry their Fiancé upon entering Australia.

Within 9 months of your visa grant (Subclass 300) you are required to Marry your Prospective Spouse in Australia.

 

Who can apply:

You can apply for this visa If you are the partners or spouse of someone who is the following;

 

  • Australian Citizen
  • Permanent Australian Resident
  • Eligible New Zealand Citizen

This Visa allows you to do the following:

  • You must arrive in Australia Before Marrying your Fiancé
  • Travel and stay in Australia for 9 months until you Marry you spouse and then you apply for Partner visa (Subclass 820.801)
  • Study in Australia provided you can cover the study fees
  • Can work in Australia temporarily
  • You can travel in and out of Australia within the 9 months period

An applicant of (Subclass 300) visa must meet the requirements of the following;

  • Must be over the age of 18 years of age when you apply for this visa
  • Must Intent to Marry your Prospect Spouse within 9 months of your visa grant, hence before your visa expires
  • Meet Health requirements
  • Meet Character requirements

Visa Validity:

The Prospective Marriage (Subclass 300) is temporary visa. This visa is valid for 9 months from the date of grant until you marry your Prospect Spouse.
